(Wednesday April 16, 2014, New York City)  If his twenty years away from New York City policing did anything for Bill Bratton it was to make him an even shrewder politician then he was.  In his latest version as NYPD Commissioner, Bratton 2.0, he has already staked his claim to plots on the political landscape that his predecessor Ray Kelly never knew existed and, even if he had, he would have paid them little attention.  This early on in his second tenure as the Police Commissioner has already provided a fairly clear picture of where he intends to direct the NYPD.  Perhaps he has just become so enamored of himself that he actually is acting with objective intelligence, logical and practical fact rather than what appears to some as just simple, blatant , dirty politics.  It has also become evident in the last few weeks the deep seated animosity Bratton has against Kelly and that is surely more akin to jealousy; Bratton is no Kelly and never will be.  That Bratton has seemingly gone out of his way to trash Kelly in very public forums reveals Bratton’s trite, vindictive, undisciplined sides that work in tandem with his outsized ego and sense of absolute authority.  Whatever Bratton once was as a Police Commissioner is long gone and only the sharp, pointy skeletal fragments remain.

On the same day a video clip was aired on CNN and the story of it widely reported in other news outlets showing the second in command of Al Qaeda, Nasir al-Wuhayshi, deliver a fiery speech before an audience estimated to number near 100 hard core zealots, Bratton decided to dismantle one of the off-shoot Intelligence Division Units that was constructed by Kelly in the wake of September 11, 2001.  Despite the Unit’s policies, protocols and tactics having been vindicated in two separate court cases, Commissioner Bratton thought it would be better to “heal” what he referred to as “poor relationships” between members of the Muslim, Islamic, Arabic and Middle East communities within the Five Boroughs and the NYPD.  There are two other lawsuits pending that question the legality of the activities of the Zone Assessment Unit, formerly known as the Demographics Unit although those very same questions have been answered in the affirmative, not only in courtrooms, but by legal scholars and constitutional lawyers.

The video clip that was released on several radical Islamic web sites is now being analyzed frame by frame by the CIA and NSA. High placed sources in the intelligence community agree that it is authentic.  As al-Wuhayshi grows angrier during his tirade he makes the comment, "We must eliminate the cross. [...] The bearer of the cross is America!"  According to intelligence sources, it was unusual to have so many high ranking al Qaeda members travel to one place for their conclave and that it has been “quite a while” since this much “chatter” from the terrorist organization has been accessible. 

When Michael Bloomberg succeeded Rudy Giuliani he chose Ray Kelly to serve as his Police Commissioner.  Kelly, whose apartment is in Battery Park City just blocks from where the Twin Towers once stood, realized that he would need to develop and implement new, novels strategies and tactics for the Police Department he commanded now that the terrorist had brought their war to our City. Kelly was determined to insure, as best he could, that the City and her people are never surprised such as they were on 9-11-2001.  Kelly was convinced that all the federal and military intelligence agencies were worthless; staffed by pension-padding, disinterested, disgruntled employees still preparing to fight the next world war with the USSR.  Kelly went to the Mayor with his plan to organize a new Intelligence Division dedicated to the external threats to our City.  NYPD already had an Intelligence Unit but their primary focus was on gangs, gun and drug runners and organized crime. That Unit would remain largely unchanged; they would be enfolded into this new Intel Division. As the plans were developed for this revamped Intel Division the PD and City lawyers were in on it from the very beginning.  All involved realized they might be treading a fine line between their vision and the constitutional rights afforded to all who live here.

As all the details were being hammered out Kelly brought two veteran Intelligence Officers to oversee his new Division. Both David Cohen and Richard Daddario were long time CIA Officers and were more than eager to come to New York and be a part of this new Division.  Kelly was also recruiting in the from the Ivy Leagues colleges for computer scientists, analysts of every stripe as well as seeking out more people to work as linguists since some of the languages spoken by terrorists are not commonly taught in colleges here.  Now, with Cohen installed as the  Deputy Commissioner of Intelligence and Daddario serving as the Deputy Commissioner for Counterterrorism the Division began to take shape, grow and go on to be an important component in the array of Intelligence gathering and analysis deployed throughout the City.  Another well respected and highly regarded CIA Officer joined the Division at the request of Cohen and then CIA Director William Tenet allowed Larry Sanchez to work with the NYPD.  It was Sanchez who orchestrated many of the operations of the Zone Assessment Unit.  It should be noted that the Intelligence Division created under Kelly stands as the premier Unit of its type and is the model for cities from coast to coast and abroad as well.

So, with the departure of Bloomberg and a new Mayor in City Hall the entire “brain trust” of the Intelligence Division resigned.  It is always customary for some officials such as the NYPD Commissioner to offer his resignation whenever there is a change of Administration.  Their resignations were expected but the men and women working in that particular Unit, conducting various details and operations did not really believe that de Blasio and Bratton would ever be so foolish as to actually disband one their operational intelligence tools.  But, sadly, they were wrong.  That is precisely what happened.

One might now wonder who will fill the void atop the Intelligence Division and what will become of the Detectives and Officers who were assigned to the Zone Assessment Unit.  As has been reported and confirmed by a ranking member of the Intel Division, those personnel have already been “reassigned” by the man who replaced the powerhouse trio of Kelly, Cohen and Daddario, former TV News journalist and longtime Bratton side kick, John Miller.  Miller is now in command of the Intelligence Division and, as several members of the Division commented, “There will be more profound changes around here.  Having Miller as Deputy Commissioner for Intel is an insult to all of us who have been here since day one.  Miller is a PR (public relations) guy, not an intelligence expert”.

While Ray Kelly worked 12 – 14 hours for most of his tenure from 2002 to 2013, Bill Bratton spent most of that same time as a high priced public speaker and “consultant”.  He was able to cash in on his police experiences and was handsomely rewarded for his efforts in the private sector.  Ray Kelly’s agenda, it is fair to say, was a bit more urgent. The threat of further terrorist attacks haunted most New Yorkers for the years immediately following 2001. As the years passed it seemed that much of the City had moved on and become complacent and aggravated by some of the new security restrictions that have altered large swathes of Midtown and other sectors throughout the City.  Many began to complain about how the City was being transformed into a “surveillance state” as more and more closed circuit cameras began sprouting up all over the City.  Activists asserted that the rights of the people were being trampled but, as has been stated already and recounted in many sources over the last decade, that was not and never has been the case.  
 
Complacent, aggravated, inconvenienced, frustrated or whatever the public sentiments were they were secondary to providing them with safety and security.  The public, civilians can afford to feel those emotions while the men and women in the trenches, the members of NYPD who now keep tighter grips on some of our landmarks, government buildings, the Wall Street Area, just to name a few, have remained ever vigilant.  Constant vigilance is our most effective weapon.  With the disbanding of the Zoning Assessment Unit we have just lost a layer of protection and prevention for no reason other than it was causing some alarm in certain segments of the City.  De Blasio and Bratton will cave to pressure from their “constituents” but, if, God forbid, we suffer another attack, there will be hell to pay.  Let’s hope we never find out just how much more vulnerable we are today than we were yesterday.  Al Qaeda is most certainly monitoring developments here, we remain their primary target.  We should also hope that John Miller is a fast learner.

(Monday March 31, 2014 19th Precinct,UES, NYC)  It is one thing to have a new Mayor struggling to get his Administration off the ground to be booed and jeered as he threw out the ceremonial “First Pitch” at Citi Field in Flushing Meadows earlier today, the home of the New York Mets. The boisterous reception Mayor de Blasio received was more a demonstration of New Yorker’s tradition and a mighty touch of Spring Fever; after a record breaking brutal winter that landed punch after punch on our City, it is finally Spring.

As the spectators at Citi Field made their thoughts known there was an equal amount, perhaps a much greater amount of jeering and booing in the locker rooms of NYPD’s 77 Precincts, 12 Transit Districts, 9 housing Police Serving Areas as well as in every special Unit throughout the Department.  Their expressions of dissatisfaction and frustration could not have been any further removed from the new Mayor’s growing unpopularity.  The hue and cry within NYPD is in the creation of a new post, the position of NYPD Inspector General (IG).  There are so many important questions surrounding this newly created IG Position that most of the upper echelon in One Police Plaza, including the new NYPD Commissioner himself, Bill Bratton, are unable to provide any specifics as to the role this IG is expected to play in an organization that is tightly knit, steeped in tradition and already the most scrutinized Police Department in the United States, if not the free world. 

The creation of the Inspector General position was passed by the NYC Council in 2012 and rapidly vetoed by then Mayor Michael Bloomberg.  The City Council was able to override the Mayor’s veto and the position was created.  Actually the current Mayor, Bill de Blasio had made the appointment of an Inspector General for the NYPD a central plank in his campaign platform.  The argument in those days surrounded allegations that a popular, highly-effective Police patrol tactic, “Stop, Question and Frisk” (SQF), condensed by its most vehement adversaries to simply “Stop and Frisk” was an abuse of power and inherently biased.  That shorter phrase became a rallying cry for activists in various communities who contended that the entire practice of SQF was akin to “racial profiling” and that “young African American and Latino men” were disproportionally at risk for SQF. Despite the fact that the crime rates in all categories continued to decrease in the last years when Ray Kelly was the NYPD Commissioner there was no absence of critics; then candidate de Blasio being one of the most vocal.  The self-appointed “activists” as well as several prominent clergymen serving minority communities convoluted the policy and practice of SQF as obviously discriminatory and their incendiary rhetoric only served to intensify increasing their constituents’ hostility towards NYPD.   

POLICING, POLITICKING, PLACATING

Some forty or so years go the Rolling Stones famously sang, “You can’t always get what you want.  But if you try some time you  just might get what you need...” It remains one of the classics from the rock and roll days and it is as true an axiom as one might find in a philosophy text.  Standing on Park Row with the imposing edifice of One Police Plaza in front of you, you should have no doubt that as much politicking as policing is orchestrated way up on the 14th floor.  It is often a toxic brew and a dangerous combination of ingredients that are unnatural partners.  Every aspect of policing and securing the City of New York is analyzed, assessed, discussed, reviewed and approved and, there are times, some members of the brass are not pleased with the results.  Often they do not get what they want.  That alone is a good reason to keep politics as far away from actual day to day Law Enforcement.  Can you imagine if the NYPD Commissioner had to run for Office like thousands of County Sheriffs across the country do? The NYPD Commissioner is chosen by the Mayor of New York City and serves “at the pleasure of the Mayor”. That’s about as political as one might want that position to be.  However, this being New York City, the most famous City in America, if not the world, NYPD and whoever leads it is constantly subject to a level of scrutiny a lab rat couldn’t withstand.

Another old axiom that could have been posed to all those hundreds of thousands of NYC voters, a “broad coalition” was, “Be careful what you wish for. You just might get it”, and thus far they are now seeing what they wanted, what they expected may indeed not be anything close to what they’ve gotten, at least up to this point. As bitter at Mayor Bloomberg as they were and dissatisfied with Ray Kelly’s NYPD, they viewed the tall candidate with a supportive, assertive African American wife, as the man who really would “be Mayor for the entire City”.  As de Blasio faces every day all day the reality of the duties of his office and just how challenging a job it is, his supporters are already growing restive and feel disillusioned.  So, obviously, this is a good time to lift all their spirits and appoint an Inspector General to…what,…oversee the Commissioner?...Oversee the Internal Affairs Bureau (IAB)?...or is he the first inhabitant of an office that is not only redundantly redundant but also completely baffling to many  of the “old hands” in the Department?  Despite several phone conversations with well-placed sources ensconced in 1PP earlier today, not one could provide a legitimate answer for that question: what the hell is an IG going to do?.  What each of them did express were opinions ranging from “Let’s wait and see” to “I’m putting my papers in tomorrow.  Fuck it.”  The last thing NYPD needs at this time is a “brain drain”, a mass exodus of Cops who worked their way up through the ranks, Cops who earned promotions and Gold Shields based on their dedication, sacrifice, service and valor not quotas or appeasement.

LET’S MEET THE MAN

Last Friday New York City appointed its first-ever Inspector General for the NYPD — Philip Eure.  Eure, a lawyer by training is currently the Head of the District of Columbia Office of Police Complaints. He has held that post for many years and has functioned as more of a placater between the Washington, DC inner city community and the Washington DC Metro Police.  His position in DC appears to be just as nebulous as it has been eluded to be here.  In the weekly game of musical chairs that is the accountability session, IG Eure might be the one left standing when the music stops.  The NYPD already do and have answered to a Civilian Complaint Review Board (CCRB), has a more “proactive” Internal Affairs Division (IAD) and has as many lawyers on staff as does any entity with 35,000 plus employees.  Will Commissioner Bratton be held accountable to IG Eure or will he focus his attentions elsewhere?  These are the pressing questions that no one can answer with any specificity.

WHO IS THIS GUY?

Anyone old enough to recall the days of Dr. Downtown Lee Brown, an outsider that then Mayor David Dinkins installed as his second Police Commissioner, NYPD can be a very difficult organization to be accepted by.  Philip Eure is another “outsider” and has many “hearts and minds” to win over in the rank and file, the heads of the various unions, and the top brass Bratton has implanted on the floors below him at 1PP.

Mr. Eure did serve a stint as a Federal Prosecutor before drifting towards positions more closely affiliated with actual Law Enforcement.  Still, many Members of Service (MOS) of the NYPD have expressed grave doubts about his capabilities and his jurisdiction.  Speaking with an MOS earlier this evening working a foot post near the Russian Mission on 68t Street, who spoke only under an agreement of anonymity noted, “I don’t know what to make of it.  None of us do.  It seems that the Job is always trying to make the Job harder.  We’ve already got enough scumbag IAD guys, guys who were chosen right out of the Academy so they wouldn’t have any relationships with other Cops, wasting time and money on bogus “sting” operations on Cops?  It’s like every night you go to work and it’s like what the fuck”.

We will all have to wait and see.

(Saturday February 8, 2014 JFK Airport, Queens, NYC)  Since its formation in 1921 the Port Authority of New York / New Jersey (PANYNJ) has been a highly regarded and much emulated bi-state alliance.  When the original charter was crafted, those involved in that process could never have envisioned what it would become.  The Port Authority as locals refer to it daily fulfills a mission that has only grown in scale and scope in the post 9-11-2001 era.  Much of this regions critical infrastructure from the three local airports to Hudson River crossings, road and rail transportation as well as properties on both sides of the Hudson they own and operate, the Port Authority is a vital element assuring the safety and security of their facilities while moving hundreds of thousands of New Yorkers and commuters from the NYC Metropolitan Area.

Until very recently the PANYNJ was seen as a non-political Agency left alone to carry out their mission. Recent headlines regarding the alleged malfeasance of New Jersey Governor Chris Christie and his high ranking appointees to the PA have begun to tarnish an impressive reputation of efficiency, effectiveness and competence.  Some of the most heavily travelled bridges and busy airports are often stricken by unforeseen events such as heavy surface congestion, power interruptions and other delay inducing events and those affected by such delays and inconvenience will complain to no end.  However, these very same people are dependent on the Port Authority and, when the systems are functioning without any glitches are able to take the PA for granted.  Given the density of the NYC Metro Area population, aging infrastructure in New Jersey and New York, the PA keeps the region moving by the dedication and expertise of their rank and file employees from their own Police Department to the legions of specialists charged with insuring the whole interconnected regional network runs as trouble-free as possible.

AN UNWITTING PAWN

One would be hard pressed to find incidents of corruption, political wrangling or run of the mill chicanery in the Port Authority.  Actually the fact that in its almost 90 year history it has remained among the brand of political corruption, influence peddling, extortion and greed that has come to define the political landscape of this region, is in itself remarkable.  To see the PA now to have been used as a pawn in the most amateurish spiteful manner as recent media reports suggest, is an insult to all who work or have every worked for the PA.  It appears that Governor Christie installed a small cadre of loyalists into the hierarchy of the PA and used them to carry out some sort of retribution against Mark Sokolich, the Mayor of Fort Lee NJ, the host city of the western terminus of the George Washington Bridge.  If these allegations are proven to be true everyone involved should be punished to the fullest extent of the law.

LANDMARKS AND ICONS

Some of this region’s most critical infrastructure and iconic sites fall under the control of the PA.  From the majestic George Washington Bridge, the Bayonne Bridge the Holland and Lincoln Tunnels, Outerbridge Crossing, The PATH trains, as well as Kennedy, LaGuardia and Newark Airports, such locales are almost as familiar to the millions who come to visit here annually as they are to those of us who live and work here.  The Twin Towers of the World Trade Center were built, owned and operated by the PA under the vision of Austin Tobin who ran the PA for almost 30 years.  There were political agendas to be addressed, no politicians’ egos to stroke; Director Tobin saw the value in each and every project he presided over not just as the head of the PA but also as an accomplished engineer.  It was during his long, successful tenure that the Port Authority was planted in the fertile soil that allowed it to flourish unencumbered by petty politics.  Some may argue this point as an inaccurate portrayal of the man Tobin and his Agency, the PA but extensive research into the PA yields no stories, rumors, innuendos or suppositions that credibly contest this point.

PORT AUTHORITY BY THE NUMBERS

Operating two bus terminals, one near the upper tip of Manhattan on 178th Street, the other on 8th Avenue and 42nd Street, these two locations transport upwards of 70 million people annually.  Every work day the PATH Trains move over 29,000communters from Hoboken and Jersey City to the west side of Manhattan.  Fleets of ferries that had long plied the Hudson but died away until the late 1990’s once again are plentiful from New Jersey and Brooklyn into lower Manhattan.  Between JFK, LaGuardia and Newark/Liberty airports over 60 million travelers pass through these PA operated hubs. 

Living in the NYC Metro Area sometimes it is easy to forget that NYC became what it is today due to geography.  From Colonial days the value of NYC as a seaport, as a major deep water maritime harbor capable of handling heavy volume of immigrants and freight, made our waterfront the premier shipping destination between the fledgling United States and the rest of the world.  After the introduction of containerized freight in the late seventies many saw the days of New York’s waterfront as over.  But, ever adaptable to change the PA cast their gaze and attention to the rapidly increasing freight brought to dock at the Port Elizabeth/Port Newark complex.  Today that complex is one of the busiest in the country.  The Port Authority is also responsible for the safety and security of the piers in Red Hook Brooklyn and adjacent docks.

One of the more obscure but important numbers, a figure that illustrates the enormous domain of which the PA is responsible is that the Port Authority Police Department (PAPD) is the 26th largest Police Force in the United States. Think about that for a moment.  Hundreds of cities and urban centers have smaller Police Forces than does the Port Authority. Given that the PAPD does not operate within the well-defined borders of a jurisdiction, this fact is impressive.  The PAPD are, in a sense, far flung being that they are deployed at facilities all across the NYC Metro Area.  Their tasks have only gotten more difficult since the terrorist attacks on September 11, 2001.  On that day the PAPD lost 37 of her Members of Service (MOS), the single most lethal day in their history is another sad chapter in the stories of courage, duty and sacrifice exhibited so valiantly by all the Agencies involved as First Responders.

The initial claim at the beginning of Governor Christie’s now scandal ridden administration was a mysteriously authorized land closure of designated roads leading from Fort Lee onto the George Washington Bridge (GWB).The GWB is the most heavily travelled bridge in the United States and is the only link directly from Interstate 80 and 95 onto the Cross Bronx Expressway which links to the network of highways going north to New England.  Sure, commuters in this area are more than familiar with traffic congestion and jams but the four days of lane closures in question affected far more than frustrated motorists; school buses and emergency response Agencies had their movements and response time impacted by the enormous gridlock that had, in effect, made Fort Lee a parking lot.  If for no other reason than this the various legislative committees and federal prosecutor investigated this sloppy episode need to find answers.  If Chris Christie did have ANYTHING to do with the lane closures he should either resign a la Sarah Palin and take a job with the other barking seals at FOX News or gut it out and wait to be impeached.  Either way his once notable political potential is gone; the luster of a “straight-shooting” Republican Governor from a Democratic state has been sullied beyond repair.

EVERY OTHER DAY

Christie’s most highly placed appointees at the PA as well as his Chief odd Staff, Deputy Chief of Staff, Lt. Governor and about 20 others within Christie’s innermost circle have been subpoenaed, resigned orr have been unceremoniously fired.  At some point the truth should emerge given the intense focus on the local and national media.  However, no matter when and where fault is laid, regardless of which political hack or “no show” appointee is left holding the bag; the one truth that ought to be recognized is that this entire sordid tale is not about the PA.  It is about politicians and pettiness, about hubris, power and corruption.  It should not in any way reflect on the thousands of hard working men and women of the Port Authority of New York & New Jersey.
